Kim Zolciak is trying to get Kroy Biermann's divorce petition shut down after he filed to end their marriage — for the second time — in August.
On Sept. 26, the former "The Real Housewives of Atlanta" star responded to the retired NFL player's second divorce petition, telling the court that they've had "marital sexual relations on multiple occasions" since Kroy filed, Page Six reported.
TMZ further reported that Kim even listed the last time they got busy — Sept. 7 — which to her means the retired NFL player's claim that their marriage is "irretrievably broken" is "demonstrably false." Kim further claimed in her response that she believes their marriage is "viable" and she wants the divorce thrown out.
Kroy, however, doesn't agree with Kim.

On Sept. 26, TMZ obtained new legal documents that Kroy Biermann filed in which he says that even though he's resumed "marital … relations" with Kim Zolciak, it "does not indicate a desire to reconcile" and he "remains steadfast in his desire to divorce" her.
According to Kroy's docs, because of their financial troubles, their home will be foreclosed on in November. He wants to sell their home before that happens and use the proceeds to try to pay off some of their debt, but he thinks Kim is trying to prevent that from happening.

On Aug. 24, retired NFL player Kroy Biermann filed divorce documents for the second time in four months after nonstop "nasty" fights with reality star wife Kim Zolciak — mostly over their unenviable financial situation, reports claimed.
However, in the days following Kroy's second filing, Kim wasn't acting like her marriage was over. When she and her oldest child, daughter Brielle Biermann, landed at LAX Airport in Los Angeles on Aug. 28, a TMZ videographer asked if there was any chance of another reconciliation, prompting Kim to flash the massive diamond engagement ring and wedding band on her hand. Brielle, meanwhile, pointed out that her mother "has the ring on," implying that it's not necessarily over for good between her parents. "We'll see," Kim added coyly.

Multiple media outlets have reported that they were essentially fighting on a daily basis. During one argument, the former "The Real Housewives of Atlanta" star "dared" Kroy to file for divorce, so he called her bluff and did just that.
The pair's "nasty" arguments allegedly mostly stemmed from their money issues: Kim and Kroy reportedly blame each other for the financial mess they're in. "They've gotten ridiculously petty over who hasn't paid bills. They're counting down to pennies," said a TMZ source.

This isn't the first time Kroy Biermann has had enough. Back in May, he and Kim Zolciak both filed for divorce, and things between them quickly turned ugly. She accused him of abusing drugs and claimed that their kids weren't safe around him. He accused her of having a gambling problem. Kroy also said Kim needed a psychiatric exam for "narcissistic personality disorder."
Then in July 2023 — after months of nastiness and name-calling — Kim and Kory pulled the plug on their divorce. At the time, TMZ reported that the two were getting along well and wanted to work it out for the sake of their four young children. On July 7 — less than a week after she and the former Atlanta Falcons player were seen at church together — the former "The Real Housewives of Atlanta" star filed a petition to dismiss their divorce. There were reports at the time that Kim and Kroy were leaning on their faith to help repair their marriage.
But faith couldn't fix their financial woes…

Kim Zolciak and Kroy Biermann's finances are in shambles. It's been reported that the duo has been building debt for a decade and owe more than $1 million in unpaid taxes. According to TMZ, the former couple owes $1.1 million to the IRS for unpaid taxes, interest and penalties from 2013, 2017 and 2018. They also owe the state of Georgia $15,000 for unpaid taxes from 2018.
Earlier this year, Kim and Kroy's Georgia mansion went into foreclosure and was set to be auctioned off after they defaulted on their $1.65 million loan. The couple was able to work out a deal to keep their mansion off the auction block, and Kim called the fiasco a "misunderstanding."
Their financial struggles weren't limited to their house, though. On Aug. 25, TMZ reported that a credit card company, Capitol One, was going after Kim for more than $150,000 in unpaid debt. In June, Target sued Kim over an unpaid balance of about $2,500 on her Target credit card.
Kim's eldest child, daughter Brielle Biermann, also had some money issues. American Express said the 26-year-old had an unpaid balance of $12,870.25. Amex filed a lawsuit demanding payment. Brielle's rep later said the reality TV star planned to make things right with the credit card company.

Kroy called Kim a "narcissist to the extreme level" and told the cops that her gambling was a huge problem. "It's probably been going on for pretty much our entire marriage and it's gotten significantly worse," he said. "In the last two years, she's gambled away $700,000 — just in the last two and a half years. The total in the marriage was about $1.5 million dollars — and she does it online." He then alleged that most of Kim's gambling was done illegally and claimed that her financial losses had "decimated everything."
Kim, meanwhile, told police that Kroy was "crazy" and exhibiting aggressive behavior.

In his latest divorce filing, Kroy Biermann asks for sole legal and physical of the four minor children he shares with Kim Zolciak as well as child support, alimony and attorney's fees. Despite the divorce filing and the clear bad blood, it's believed that the estranged couple is still cohabitating in their Alpharetta, Georgia, home for the sake of their young children.

Back in 2017, Kim Zolciak boldly claimed that divorce is "not an option in my house." The statement came after she was confronted with the fact that many "Real Housewives" marriages fail after they're featured on Bravo. "I would never allow a show to impact my marriage in any way," she said at the time. "My marriage is definitely first." She told Fox News that the "hype of TV and the publicity" were to blame for other reality TV stars' failed marriages. "It's easier to get divorced" than fix the problems, she said.
